The company that owns the New York Stock Exchange just agreed to operate perpetual futures markets built on Hyperliquid, pending US regulatory approval. It isn't live yet, but the market moved fast: HYPE spiked 22% to Thursday's high and now sits about 10% above its pre-news price.
Perps and HIP-3 in 60 seconds
Perpetual futures (perps) are contracts that track an asset's price but never expire. To keep the perp price close to the real market price, longs and shorts pay each other a small funding fee every so often. Leverage lets you control a bigger position than your deposit, so gains and losses are both magnified. If price moves against you far enough, the exchange closes your position (liquidation) and you can lose your whole margin.
HIP-3 is a Hyperliquid feature that lets builders who stake 500,000 HYPE launch their own perp markets on Hyperliquid, setting the price feed, contract specs and leverage limits. Trade[XYZ] is one of these builders.
What happened
On Thursday 29 October, Intercontinental Exchange (ICE), the parent of the NYSE, announced a definitive agreement with Trade[XYZ] to bring Trade[XYZ]'s perpetual markets onshore in the United States, subject to regulatory approvals.
The detail that matters: the deal is with Trade[XYZ], not with Hyperliquid itself. Trade[XYZ] is a builder that deploys real-world-asset perpetual markets on Hyperliquid. According to The Block, the split looks like this:
- Hyperliquid supplies the underlying technology, via HIP-3.
- Trade[XYZ] designs and implements the markets.
- ICE is the exclusive operator of Trade[XYZ]'s regulated markets and plans a new, dedicated retail market and clearing structure for them.
ICE is also making a strategic investment in Trade[XYZ]. The release calls it a minority position and doesn't disclose its size. ICE says it isn't expected to have a material impact on its 2026 adjusted financial results.
The planned products are 24/7 perpetual contracts across crypto, equities, indices, commodities and FX, aimed at retail traders. Distribution is expected through brokers and platforms, including ICE's joint venture with OKX.
Why it matters
- A big name from traditional finance. One of the world's largest exchange operators plans to build a regulated product on top of a decentralized derivatives platform.
- Retail is new for ICE. ICE says its participation today is more than 99% institutional, so this is a new business line, run separately from its institutional futures and clearing.
- A path onshore. Trade[XYZ] currently serves eligible users outside the US. If approved, KYC/AML-verified customers would access the markets through futures commission merchants (FCMs) that become members of the platform.
CEO Jeffrey Sprecher put it this way: "We see these perp markets as additive to our futures markets, not a replacement for them."
What's not done yet
- Approvals first. Everything is subject to regulatory approvals, including those needed for leveraged trading. The release doesn't name a regulator or give a launch date. For context, The Block reports the CFTC (the US futures regulator) issued a staff advisory and no-action relief for US perps in May. Approval for this specific market is still pending.
- Not available to US traders yet. Today Trade[XYZ] serves eligible users outside the United States only.
- The OKX route has its own approvals pending. Distribution through the ICE-OKX joint venture depends on that JV's own registrations as a US broker-dealer and FCM.
- HYPE holders get no direct stake. ICE's investment is in Trade[XYZ], not in the HYPE token.
HYPE price: what the chart shows
Data: Hyperliquid HYPE-USD perpetual, pulled from Hyperliquid's public API on Sat 31 Oct at 18:06 Cyprus time.
- Before the news: HYPE closed at $79.28 on the hourly candle ending 12:00 Cyprus time on Thursday 29 Oct. The next candle opened the move.
- Spike high: $97.11 at 18:00–19:00 Cyprus time on Thursday. HYPE spiked 22.5% from the pre-news close to that high.
- Thursday's daily candle: opened at $80.57 and closed at $88.96, about +10.4% (UTC day).
- Now: about $87.56, still +10.4% above the pre-news close but 9.8% below Thursday's high.
- Context: the 90-day high of about $98 (23 Sep) is also HYPE's all-time high on Hyperliquid's daily data. Thursday's spike stopped just short of it. The 90-day low is about $51–52 (early August).
What traders should watch: whether HYPE holds above the pre-news area near $79–80 if the excitement fades, and how it trades at Thursday's $97 high and the $98 area. A daily close above that zone would mean a new all-time high; failing there would leave it as resistance.
What to watch next
- Any regulatory filing or approval naming the regulator and a timeline.
- Updates on the ICE-OKX joint venture's broker-dealer and FCM approvals.
- HYPE's daily close against the $79–80 pre-news area below and the $97–98 highs above.
